NEWLY BUILT APARTMENT BUILDINGS PROPOSED TO BE MANAGED BASED ON THEIR DESIGN LIFESPAN
The Central Committee has recently issued Resolution No. 21, outlining key directions for amending the Land Law and related legislation. The resolution introduces several policy orientations aimed at improving the legal framework governing housing, land management, and the real estate market while enhancing the efficient use of land resources. Among the notable proposals is a new approach to managing newly built apartment buildings according to the design lifespan of the structure.

Apartment Management Linked to Building Lifespan
Under the Resolution, newly developed apartment projects may have their period of use managed based on the design lifespan of the building. Once a building reaches the end of its designed service life and undergoes the required safety assessment, reconstruction or redevelopment would be carried out in accordance with applicable regulations while ensuring the lawful rights and interests of apartment owners.
This policy direction is introduced alongside the broader objective of safeguarding property rights as Vietnam continues to revise its legal framework on land and housing.
Toward a More Sustainable Housing Market
In addition to apartment-related policies, the Resolution outlines several measures intended to promote a more transparent and sustainable real estate market.
The Central Committee proposes encouraging the development of rental housing through preferential land policies to attract private-sector investment, thereby expanding housing supply and improving affordability for different groups of residents.
For land managed by the State, land allocation and leasing are expected to continue being carried out primarily through public land auctions or competitive bidding for land-use projects, with an emphasis on transparency, fairness, and efficient land utilization.
Shifting the Focus from Compensation to Livelihood Restoration
Another important policy orientation is the transformation of land acquisition policies.
Rather than focusing solely on compensation for acquired assets, future regulations are expected to place greater emphasis on restoring residents' living conditions after land acquisition. Resettlement areas are envisioned to provide adequate infrastructure, essential public services, and conditions that support long-term livelihoods.
The Resolution also encourages a more coordinated approach to compensation, assistance, and resettlement programs so that affected households can stabilize their lives more effectively.
Land Pricing Based on Transparent Data
The Resolution further emphasizes improving the land valuation mechanism by relying on comprehensive data, scientific methodologies, and market information, while strengthening the integration of land databases with other relevant information systems.
Under this policy direction, the central government would establish the general principles, criteria, and supervisory framework, while provincial authorities would continue to develop local land price schedules and adjustment coefficients in accordance with legal regulations.
Continuing Financial and Digital Reforms in Land Management
The Resolution also calls for studying financial and taxation policies that encourage more efficient land use and discourage land speculation or prolonged land abandonment.
At the same time, Vietnam aims to accelerate the development of a nationwide digital land database, improving transparency by digitizing information related to land planning, transactions, legal status, and land-use rights.
Policy Orientation Ahead of Future Legislative Reforms
Overall, Resolution No. 21 provides policy directions for the upcoming revision of the Land Law and related legislation. Specific regulations concerning apartment building lifespans, land management mechanisms, and financial policies will be further developed through draft laws and will only become legally effective after being reviewed and adopted by the National Assembly in accordance with the legislative process.
